Hague Apostille: what it is and which Romanian documents need one

The Hague Apostille confirms that a Romanian official document is valid in another country that has signed the 1961 Convention. After a death abroad or a repatriation, the death certificate and notarial deeds often require an apostille. We handle the process with the right authority on your behalf.

What is the Hague Apostille?

An apostille is an official stamp that verifies the authenticity of a document so it can be used in another country. It is placed on documents issued in a state that has signed the Hague Convention of 1961, making them automatically recognized in every other signatory state.

When a death has international dimensions — a repatriation, an inheritance in another country — Romanian documents need an apostille before foreign authorities will accept them.

Which Romanian authority issues the apostille?

In Romania, the apostille is issued by different institutions depending on the type of document:

Document typeIssuing authority
Civil-status records, criminal records, educational diplomasInstituția Prefectului (Prefect's Office)
Court judgments, bailiff documents, Trade Register recordsTribunalul (County Court)
Notarial deeds, certified translations, notarized copiesCamera Notarilor Publici (Chamber of Public Notaries)

Does the death certificate need an apostille?

The death certificate is a civil-status record, so the apostille is placed on it by the Instituția Prefectului (Prefect's Office) of the county where it was issued.

For a repatriation or an international transfer of remains, the destination country's authorities usually require an apostilled death certificate before they will accept the body.

Apostille vs. full legalisation (supralegalizare)

The apostille applies to countries that have signed the Hague Convention. For countries that have not joined the Convention, a longer procedure called supralegalizare (full legalisation) is required instead.

We check for every case whether the destination country accepts an apostille or requires full legalisation, so you are not sent to the wrong office.

Does the document also need a certified translation?

Often, yes. The document usually also needs a certified translation into the language of the destination country. The order matters: in some cases the document is apostilled first and then translated; in others, the translation itself must also be apostilled.

We coordinate the translations in the correct sequence for each country.

How long does an apostille take?

At the Instituția Prefectului (Prefect's Office), an apostille typically takes one to two working days — sometimes it is issued on the spot, depending on workload.

For notarial documents processed through the Camera Notarilor Publici (Chamber of Public Notaries), the turnaround may be slightly longer. We give you a realistic timeline before you commit to anything.

FREQUENT QUESTIONS

Answers to frequent questions

  • What is the Hague Apostille?

It is an official stamp that verifies the authenticity of a document for use in another country that has signed the Hague Convention of 1961.

  • Which documents need an apostille after a death?

Most commonly the death certificate, but also notarial deeds, powers of attorney, or certified translations when they are used abroad — for repatriation or probate.

  • Who apostilles the death certificate in Romania?

The Instituția Prefectului (Prefect's Office) of the county where the certificate was issued, because the death certificate is a civil-status record.

  • Who apostilles notarial deeds?

The Camera Notarilor Publici (Chamber of Public Notaries) that covers the area where the notary operated. The same body apostilles certified translations and notarized copies.

  • Who apostilles court judgments?

The Tribunalul (County Court). It also apostilles documents issued by bailiffs and by the Trade Register.

  • What is full legalisation (supralegalizare)?

It is a lengthier procedure used for countries that are not party to the Hague Convention. The document passes through several authorities rather than receiving a single apostille stamp.

  • Do all countries accept the apostille?

Only countries that have signed the Hague Convention. For all others, full legalisation is required. We verify what the destination country requires for each case.

  • Does the document need to be translated before apostilling?

It depends on the country. Sometimes the document is apostilled first and then translated; sometimes the translation itself must also be apostilled. We coordinate the correct order for each case.

  • How long does the apostille take?

At the Prefect's Office, usually one to two days, sometimes on the spot. For notarial documents through the Chamber of Public Notaries, the turnaround may be slightly longer.

  • Can I submit the documents myself or do I need an agent?

You can submit in person or through an authorised representative. With a power of attorney, we handle submission and collection for you so you do not need to travel.

  • How much does an apostille cost?

There is a small fee set by the issuing authority. Translations and coordination are quoted separately. We give you a clear breakdown in advance.

  • Is an apostille required for repatriation?

Often, yes. Many foreign authorities require an apostilled death certificate. We verify the exact requirements of the country involved in each repatriation.

  • Is the medical death certificate (certificatul medical constatator) apostilled?

Usually it is the civil-registry death certificate that is apostilled, not the medical one. We tell you exactly which document the foreign authority requires.

  • Does an apostille expire?

The apostille itself does not expire. However, some foreign authorities may require a recently issued underlying document. We check requirements before submission.

  • Can a power of attorney for probate abroad be apostilled?

Yes. Powers of attorney and notarial declarations are apostilled through the Camera Notarilor Publici (Chamber of Public Notaries) for use in another country's probate proceedings.

  • What documents must be presented to obtain an apostille?

The original document issued by the Romanian authority. For notarial deeds, the notarial original. We verify the required form before submission.

  • Can I obtain an apostille in a different county?

  • How do you help with the apostille?

We identify the correct authority for each document, prepare the files, coordinate translations, and — with a power of attorney — submit and collect everything.

  • Is the apostille placed on the original or a copy?

Usually on the original document or a notarized copy. The required form depends on the type of document; we verify this before submission.

  • Can the same apostilled document be used in multiple countries?

Yes, in any signatory state of the Hague Convention. The apostille confirms the document's authenticity for all those countries, not just one.

  • Can a criminal record certificate be apostilled?

Yes. A criminal record certificate is an administrative document, so the apostille is placed on it by the Prefect's Office, as with civil-status records.

  • What if the country does not accept an apostille?

If the country is not party to the Hague Convention, the document goes through full legalisation. We verify the correct procedure for every case.

  • Can educational diplomas be apostilled?

Yes. Educational diplomas are also apostilled through the Prefect's Office, after prior endorsement by the relevant ministry where required.
