What Law 102/2014 is
Law 102/2014 is the law that regulates cemeteries, crematoria, and funeral services in Romania. It came into force in 2014 and has been supplemented with technical and sanitary standards.
Its purpose is a uniform, transparent framework for funeral activities, ensuring a dignified farewell and civilised conditions for those who have passed.

What the law covers
The law covers the entire funeral sector, from cemeteries to the services provided to families:
- Establishing, operating, and closing cemeteries
- Human crematoria and cremation
- Funeral services provided by operators
- The concession (lease) of cemetery plots
- Transport, burial, and exhumation
Who it applies to
The law applies to all those involved in the funeral sector — religious denominations and churches, local public authorities, commercial operators, foundations, and associations that own cemeteries or crematoria.
It also applies to natural and legal persons who provide funeral services or maintain cemeteries, monuments, and crematoria.

The law provides that funeral services may only be provided in authorised premises, by operators who meet professional criteria and technical and sanitary standards.

Cemeteries and the concession of plots

The law also establishes that local authorities have an obligation to ensure burial for persons without next of kin or without means.
Crematoria and cremation
The law also regulates human crematoria and cremation, with their own technical and sanitary standards. Cremation is carried out in authorised crematoria, with the required documents.

Transport and exhumation
The transport of the deceased may only be carried out in authorised vehicles; transport in a personal car is prohibited. Exhumation is also subject to strict rules under the sanitary standards of the law.
